What is Mediation?
Mediation is a structured negotiation process in which an independent person, known as a mediator, assists the parties to identify and assess options and negotiate an agreement to resolve their dispute. Mediation is an alternative to a judge imposing a decision on the parties. (Federal Court of Australia)
Mediation is faster and more cost effective way to resolve conflicts with the parties remaining in control of the outcome that mutually suits their best interests.
Lifestyle Mediation is an online (Zoom) mediation specialist while also offering person to person sessions and “shuttle” sessions (parties are separated with the mediator as the go-between) if needed. We are flexible with hours and weekend times that suit our busy clients around their family commitments and work schedules.
How Does Mediation Work
The mediation process works through a number of steps.
Each party will need to agree to mediate then do an individual 45min- 1.5 hour pre mediation intake session with the mediation specialist prior to the joint mediation session. In this private and confidential session, they explore what are the root issues of the conflict and the best and worst case scenarios, whether there is a need for translators, support person or lawyer. Making sure the parties have explored all professional advice/support and researched information regarding the area of dispute.
Both parties then choose a length of time for the mediation; 2 hours (minimum), 4 hours or 6 hours and agree on a day and time for the session to take place. They also agree on the type, whether it be online (zoom), in person or “Shuttle” where appropriate and their availability. Both parties will need to sign a mediation agreement and confidentiality form. This form will also be signed by the mediator and any other individual joining the session.
If an agreement is reached, the Mediator will write the terms of the agreement into a document that both parties and mediator sign. Parties may decide to hand the mediation document to lawyers to construct and facilitate a legally binding set of court orders.
Parties, if in agreeance, are able to have support people, lawyers and translators join the session as well.
